(dba Mack5) to Add the Amount of $100,899 for a Total Agreement Amount of $244,734 for Construction Management Services for Estuary Park; and Adoption of Resolution Amending the Capital Improvement Fund Budget for Fiscal Year 2017-18.

 

BACKGROUND

 

Estuary Park is eight acres located on Mosely Avenue near Singleton Avenue.  Construction of the first phase of the project started in August 2016 and construction is anticipated to be completed in September 2017. 

 

The first phase of construction is dedicated to athletic fields including one synthetic baseball diamond prioritized for special needs youth plus one lighted synthetic turf rectangular field for soccer, lacrosse, rugby, and football.  This will be the City’s first lighted, synthetic turf multi-use field.  It will also be the first City-owned regulation-size football field.  The synthetic turf baseball diamond, with a soccer field striped in the outfield, is designed to be fully ADA accessible with priority scheduling for youth and adults with mental and physical challenges. 

 

The second phase is a community park space with playgrounds, picnic areas, basketball courts, open lawn, and a dog park.  These recreation areas will serve the entire community, athletic field users, and the new residential housing anticipated at Alameda Landing and North Housing. 

 

On July 5, 2016, City Council approved an agreement with Mack5 to provide construction management services for Estuary Park.

 

DISCUSSION

 

This amendment is for additional services that are a result of site and project conditions discovered during construction.

 

First, it was discovered immediately prior to the start of construction that the existing utility pipes for storm drainage and sewer were not adequate, being old Navy infrastructure, and Mack5 assisted city staff to ensure that the design team responded quickly to appropriately redesign all utility connections for the park prior to construction. 

 

Second, issues were encountered with potentially hazardous soil as the site conditions did not conform to the Land Use Covenant with the Navy which required two feet of top clean soil with an orange demarcation fence below.  The fence was found at varying depths and the project was delayed until soil was tested and numerous regulatory agencies were satisfied that the soil was clean and the project could restart.  Mack5 assisted with this process and it also delayed the construction schedule.

 

Third, additional issues were encountered with unanticipated contaminated soil conditions and ground water exposure where excavations and/or foundations were required to go below four feet grade.  Per an agreement with the Navy that requires approval for any excavation deeper than four feet, the project was specifically designed to stay within the top four feet of soil.  However, certain site features, such as the storm water lift station, were required to go deeper in order to serve its purpose.  Mack5 assisted with the required approval process which also extended the construction schedule.

 

Also, due to the unusual and historically wet weather throughout the winter as well as the unanticipated issues with contaminated soil, the construction schedule was extended by up to 5.5 months.  This has a financial impact on all consultants related to the project construction. The original agreement was for Mack5 to provide construction management services for a 7.5 month construction period. Substantial completion of the project may occur before the end of September, therefore this amendment reflects that Mack5 will bill on a time and materials basis for the month of September. 

 

FINANCIAL IMPACT

 

The project is funded with monies allocated from Development Impact Fees - Parks, General Fund, Dwelling Unit Tax, grants from Measure WW and the Housing Authority and corporate and community donations. 

 

Budget for this contract is included in the Capital Improvement Program - Recreation and Parks Fund (Project No. 91311).  The City Council previously approved the original contract and the proposed contract amendment as presented below:

This action does not affect the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

The proposed project includes the rehabilitation and improvement of an existing park, the project is consistent with the zoning and general plan designation for the property, and the improvements will be subject to the existing design requirements of the Alameda Municipal Code ensuring compatibility with adjacent land uses. For these reasons, the proposed project will not result in any significant environmental impacts and is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15301 (existing facilities), 15302 (replacement or reconstruction), and 15303 (new construction or conversion of small structures).

 

RECOMMENDATION

 

Recommendation to authorize the City Manager to execute a first amendment to an agreement with Macks Craic Inc. (dba Mack5) to add the amount of $100,899 for a total agreement amount of $244,734 for construction management services for Estuary Park; and adoption of resolution amending the Capital Improvement Fund Budget for Fiscal Year 2017-18.
