BACKGROUND

 

Jean Sweeney Open Space Park (Sweeney Park) is a 27-acre park bounded by Constitution Way, Atlantic Avenue, and Sherman Street. The site is the former Alameda Beltline Railroad property that was secured by the City at its original purchase price due the advocacy efforts of long-time resident Jean Sweeney.  The Cross Alameda Trail (CAT) is a bicycle and pedestrian trail that ultimately will run the length of the island from east to west.  The trail through Sweeney Park is a protected bicycle trail and will connect with the future trail along Ralph Appezzato Memorial Parkway. 

On July 5, 2016, City Council approved a service provider agreement with Macks Craic Inc. (Mack5) for construction management services for multiple park projects. 

The approved agreement includes a provision requiring a Notice to Proceed to implement the next phase in the scope of work.  On November 15, 2016, City Council approved the Notice to Proceed for construction of the Cross Alameda Trail through Jean Sweeney Open Space Park.  This was in advance of going out to bid for the project.

DISCUSSION

 

This amendment is for additional services that are a result of project conditions discovered during construction as well as a longer scheduled construction period than Mack5 originally bid upon.

 

The original contract with Mack5 includes work on several park projects for overall cost efficiency.  These park projects included Estuary Park, Cross Alameda Trail (CAT) through Sweeney Park and Phase 2 of Sweeney Park on the eastern side.  For the original contract budget, Mack5 based its CAT project budget on city staff’s projected four month construction schedule.  This was prior to receiving bids and finalizing the construction schedule with the lowest responsive bidder.  The final construction schedule is six months and therefore it requires an additional two months of construction management services from Mack5.

 

In addition, during CAT construction, twenty additional days were added due to the discovery and management of more contaminated soil than anticipated as well as survey and grading issues that had to be resolved.  City staff negotiated with Mack5 and reduced their add service to $40,000, which includes the two additional months plus the remainder of the construction contract through February 2018.

 

FINANCIAL IMPACT

 

The Cross Alameda Trail - Jean Sweeney Open Space Park project is funded by the Active Transportation Program grant plus city matching funds from Measure B, Open Space Funds and Development Impact Fees. These funds are allocated in the Capital Improvement Program budget, Project 91614.

 

Budget for this contract is available in the Capital Improvement Program - Recreation and Parks Fund (Project No. 91614).  The City Council approved the original contract as presented below:

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

For this project, on July 15, 2014, the Council adopted a Mitigated Negative Declaration (MND) that identified minimal environmental impacts, and those that were identified are related to the construction period (e.g. dust, construction traffic, etc.).  The MND provides mitigations to minimize those impacts.  The design development plan for this project is consistent with the adopted MND and there will be no new environmental impacts that were not previously evaluated.

 

RECOMMENDATION

 

Recommendation to authorize the City Manager to execute a Second Amendment to an Agreement with Macks Craic Inc. (dba Mack5) to add the amount of $40,000 for a total agreement amount of $146,470 for construction management services for Cross Alameda Trail - Jean Sweeney Open Space Park.
