Re: Recommendation to Approve City Attorney Employment Agreement

BACKGROUND

The City Attorney position serves at the will of the City Council. The City Council approved the initial Employment Agreement for City Attorney, Janet Kern in January of 2012, approved the First Amended and Restated Employment Agreement on July 31, 2012 and approved an extension of the agreement on October 21, 2014. The current agreement expires in January of 2019. On April 3, 2018 City Council voted in closed session to extend the current contract to January 10, 2021.

DISCUSSION

The Employment Agreement between the City of Alameda and Janet Kern is set to expire on January 9, 2019. City Council in closed session approved an extension of the contract to January 10, 2021. The agreement provides Ms. Kern with a 5% salary increase effective on April 3, 2018 for an annual salary will be $237,000 per year. She will also receive a 2.5% increase effective the first pay-period in January 2019 and January 2020.

FINANCIAL IMPACT

The impact of approving the amended employment agreement for the current fiscal year is approximately $4,000. There are funds available in the City Attorneys budget to cover these costs. Future years' impacts will be included in those budgets.

This action does not affect the Municipal Code.

ENVIRONMENTAL REVIEW

This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378.

RECOMMENDATION

Approve the City Attorney Employment Agreement with Janet Kern.
