BACKGROUND

 

The City of Alameda entered into a Disposition and Development Agreement (DDA) with Alameda Point Partners, LLC, on August 6, 2015, for the development of Site A within the former Naval Air Station Alameda commonly referred to as Alameda Point (AP).  Alameda Point Partners, LLC has begun Phase 1 of the Site A development.  A major component of the Phase 1 development is the construction of the backbone infrastructure for Site A including several of the new roadways and the utility upgrades serving both Site A and other portions of AP.

 

As part of the master planning for AP, the City has developed a Master Infrastructure Plan (MIP) for AP. One significant component of the MIP is the replacement of the aging water system constructed by the Navy in the 1940s and currently owned and operated by the City with new water infrastructure owned and operated by the East Bay Municipal Utility District (EBMUD), the service provider for the rest of Alameda.

 

DISCUSSION

 

Phase 1 of the Site A development includes development of Blocks 6, 7, 8, 9, 10, and 11 along with the construction of the Ralph Appezzato Memorial Parkway extension, Orion Street, Coronado Avenue, Skylark Street, Corsair Street, and Ardent Way. These parcels and streets were created with the filing of the subdivision map for Tract 8336. The land for Phases 2 and 3 of the Site A development has not been subdivided or otherwise transferred to the developer and remains owned by the City.

 

EBMUD will be installing new water main infrastructure to support the Phase 1 development of Site A. The improvements are consistent with the MIP developed by the City in 2014 and tie in with the existing water infrastructure on Alameda Point to maintain a fully functioning water system. All of the new water mains will be located in streets newly created as part of Tract 8336 or in streets that will be created in Phases 2 or 3 of the development. There are three locations where the water mains will be located outside of Tract 8336 and in land currently owned in fee by the City.  Plat maps for the water line easements are shown in Exhibit 1.

 

EBMUD is requiring the City to dedicate water line easements at each location where the new water main will be located on City-owned property.  The first easement totals 9,338 square feet, the second easement totals 1,798 square feet, and the third easement totals 14,570 square feet.  The Grant of Easement is Exhibit 2.

 

FINANCIAL IMPACT

 

The easement will be granted to EBMUD at no charge. Alameda Point Partners, LLC is responsible for the installation costs of the new water main infrastructure.  There is no impact to the General Fund.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the MIP and Site A DDA.

 

ENVIRONMENTAL REVIEW

 

On February 4, 2014, the City of Alameda certified the Alameda Point FEIR in compliance with CEQA.  The FEIR evaluated the environmental impacts of redevelopment and reuse of the lands at Alameda Point consistent with the Alameda Point Waterfront and Town Center Plan, which included Site A.  Consistent with the February 2014 action, on May 11, 2015, the Planning Board approved a resolution containing conditions of approval that require that the Site A development comply with, and implement, all the relevant mitigations measures adopted by the City Council in February 2014.  The DDA also includes the MMRP as an exhibit and requires compliance with all of the relevant mitigation measures.

 

Under Public Resources Code Section 21083.3 and Section 15183 of the CEQA Guidelines, where a project is consistent with the development density established by existing zoning, a community plan, or a general plan for which an EIR was certified, additional environmental review is not required.  The density and land uses of the proposed Site A development are consistent with the Town Center Plan and Alameda Point Zoning District.  This action will not result in significant impacts that: (1) are peculiar to the project or project site; (2) were not already identified as significant effects, cumulative effects, or off-site effects in the FEIR; or (3) were previously identified as significant effects, but are determined to be substantially more severe than discussed in the EIR.  Thus, the streamlining provision of Public Resources Code Section 21083.3 and Section 15183 of the CEQA Guidelines apply and no further environmental review is necessary.

 

RECOMMENDATION

 

Adopt Resolution granting three water line easements to EBMUD from the City for the installation of new water main service across City-owned property within AP, authorizing the Acting City Manager to execute any and all ancillary documents and directing the recording of the grant of easements.
