Warmerdam at an Amount of $123.75 Hourly for the Period of July 16 Through August 5, 2018

 

BACKGROUND

 

Former City Manager Jill Keimach’s employment ended May 15, 2018.  From that date until June 30, 2018, Assistant City Manager Elizabeth D. Warmerdam was contractually appointed Acting City Manager. Due to Ms. Warmerdam’s vacation plans, various department heads have temporarily served in the role of Acting City Manager since June 30, 2018. Ms. Warmerdam returned to serving as Acting City Manager on July 16, but without benefit of a contract.

 

During the first two weeks in July the City Council interviewed a number of candidates for the position of Interim City Manager. At the conclusion of those interviews Council expressed a desire to retain the services of David Rudat. Mr. Rudat has nearly 40 years of increasing responsible leadership and management experience in local and county government, including City Manager, Deputy County Executive Officer, Fire Chief, and Public Works Director. He served as the City Manager of the City of Orange for ten years and has served as Interim City Manager, and as an Interim Department Head in a variety of agencies.

 

DISCUSSION

 

The proposed Employment Agreement, a copy of which is attached as Exhibit 1, is recommending the Council approve the appointment of David Rudat as Interim City Manager from August 6, 2018 through January 31, 2018. The hourly rate pursuant to this contract is $123.75 per hour. In accordance with Government Codes Sections 21211 (h) and 7522.56 (d) as a California Public Employee Retirement System (CalPERS) retiree, Mr. Rudat may work up to 960 hours per fiscal year (July 1, 2018 through June 30, 2019 in this case) for a CalPERS employer (like the City) without impacting his retirement benefits.

 

The City Council will be working with an executive search firm to recruit a new City Manager and anticipates that the recruitment process will be completed no later than January 31, 2019.

 

Additionally, it is recommended that City Council authorize Acting City Manager pay for Ms. Warmerdam for the period of July 16 through August 5, 2018. Other City Department Heads who acted as City Manager during the period of July 1, 2018 to July 16, 2018 will be compensated for their work in accordance with the City’s administrative rules.

 

FINANCIAL IMPACT

 

If the Interim City Manager works the full 960 hours, the cost to the City is not expected to exceed $130,000. Funds for this position are already included in the City Manager’s Department Budget in the General Fund.  No additional appropriations are required for either the Interim City Manager appointment or the additional salary for the Acting City Manager.

ENVIRONMENTAL REVIEW

 

This activity is not a project and is exempt from the California Environmental Quality Act (CEQA) pursuant to section 15378(b)(4) of the CEQA guidelines, because it involves the governmental fiscal activities which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.

 

RECOMMENDATION

 

 

Approve Agreement appointing David Rudat as Interim City Manager for a term of no more than 960 hours at a salary of $123.75 hourly; and authorize Acting City Manager pay for Elizabeth D. Warmerdam at an amount of $123.75 hourly for the period of July 16 through August 5, 2018.
