EXECUTIVE SUMMARY

 

Receive and accept the CFD No. 03-1 (Bayport Municipal Services District) Report; the CFD No. 13-1 (Alameda Landing Public Improvements) Report; the CFD No. 13-2 (Alameda Landing Municipal Services District) Report; the CFD No. 14-1 (Marina Cove II) Report; and the CFD No. 17-1 (Alameda Point Public Services District) Report for Fiscal Year Ending June 30, 2018. These reports are intended to comply with the requirements of the Local Agency Special Tax Bond and Accountability Act.

 

BACKGROUND

 

Senate Bill 165, filed with the Secretary of State on September 19, 2000, enacted the Local Agency Special Tax and Bond Accountability Act. This Act requires that any local special tax or local bond measure subject to voter approval contain a statement indicating the specific purposes of the special tax; require that the proceeds of the special tax be applied to those purposes; require the creation of an account into which the proceeds shall be deposited; and require an annual report containing specified information concerning the use of the proceeds. The Act only applies to any local special tax measure or local bond measure adopted on or after January 1, 2001, in accordance with Section 50075.1 or Section 53410 of the California Government Code.

 

As special tax measures, CFD No. 03-1 (Bayport Municipal Services District), CFD No. 13-1 (Alameda Landing Public Improvements), CFD No. 13-2 (Alameda Landing Municipal Services District), CFD No. 14-1 (Marina Cove II) and CFD No. 17-1 (Alameda Point Public Services District) fall within these reporting requirements.

 

DISCUSSION

 

The City of Alameda formed CFD No. 03-1 (Bayport Municipal Services District) in 2003 to provide funding for police services and maintenance of publicly owned streets, paved walkways, a storm drain detention basin, a sanitary sewer pump station, a four-acre city park, a permanent outfall structure and a storm water treatment facility. The District was formed pursuant to the City’s Special Tax Financing Improvement Code. No bonds were issued for the District and the Special Tax is projected to be levied in perpetuity.

 

The City of Alameda formed CFD No. 13-1 (Alameda Landing Public Improvements) in 2014 to provide funding for the acquisition and construction of roadways, sanitary sewer systems and any components thereof, storm water drainage systems and any components thereof, water systems and any components thereof, parks and park improvements, curbs, gutters and sidewalks, and street lights and traffic signals. The District was formed pursuant to the City’s Special Tax Financing Improvement Code

 

In 2016, the City issued the CFD No. 13-1 (Alameda Landing Public Improvements) 2016 Special Tax Bonds in the amount of $15,415,000.  Additional series of bonds are anticipated to be issued as the District develops. The total bonds authorized for the District is $40,000,000.

 

The City of Alameda formed CFD No. 13-2 (Alameda Landing Municipal Services District) in 2014 to provide funding for police services and maintenance of bus shelters and bus stops, publicly owned streets, paved walkways, a storm drainage systems, public signage, and landscaping in public areas. The District was formed pursuant to the City’s Special Tax Financing Improvement Code. No bonds were issued for the District and the Special Tax is projected to be levied in perpetuity.

 

The City of Alameda formed CFD No. 14-1 (Marina Cove II) in 2014 to provide funding for police services and maintenance of publicly owned streets, paved walkways, a storm drain detention basin, a sanitary sewer pump station, a four-acre city park, a permanent outfall structure and storm water treatment facility. The District was formed pursuant to the City’s Special Tax Financing Improvement Code. No bonds were issued for the District and the Special Tax is projected to be levied in perpetuity.

 

The City of Alameda formed CFD No. 17-1 (Alameda Point Public Services District) in 2017 to provide funding for police and fire protection services, maintenance of bus shelters and bus stops, landscaping and publicly owned structures, public easements and public right of way, sanitary sewers, sidewalks and public containers for integrated waste, public signage, flood protection facilities, storm drainage systems, resurfacing of streets and roadways, street lighting, traffic signals, graffiti removal, and transportation demand management services and expenses. The District was formed pursuant to the City’s Special Tax Financing Improvement Code.  The City will not issue bonds for the District and projects to levy the special tax in perpetuity.

 

The attached annual reports for CFD No. 03-1 (Bayport Municipal Services District), CFD No. 13-1 (Alameda Landing Public Improvements), CFD No. 13-2 (Alameda Landing Municipal Services District, CFD No. 14-1 (Marina Cove II) and CFD No. 17-1 (Alameda Point Public Services District) intend to comply with the requirements of the Local Agency Special Tax Bond and Accountability Act.

 

FINANCIAL IMPACT

 

There is no financial impact from acceptance of these reports.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Municipal Code.

 

ENVIRONMENTAL REVIEW

 

This activity is not a project and is exempt from the California Environmental Quality Act (CEQA) pursuant to section 15378(b)(4) of the CEQA Guidelines, because it involves governmental fiscal activities, which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.

 

RECOMMENDATION

 

Accept and File the CFD No. 03-1 (Bayport Municipal Services District) Report for the Fiscal Year ending June 30, 2018;

 

Accept and file the CFD No. 13-1 (Alameda Landing Public Improvements) Report for Fiscal Year ending June 30, 2018;

 

Accept and file the CFD No. 13-2 (Alameda Landing Municipal Services District) Report for Fiscal Year ending June 30, 2018;

 

Accept and file the CFD No. 14-1 (Marina Cove II) Report for Fiscal Year ending June 30, 2018; and

 

Accept and file the CFD No. 17-1 (Alameda Point Public Services District) Report for Fiscal Year ending June 30, 2018
