Summary
The Sunshine Ordinance provides that the Open Government Commission is to prepare an Annual Public Report to be placed on the City's website of alleged violations of the Ordinance brought to the attention of the Commission during the previous calendar year and the disposition thereof. In 2018 there were three such violations. Two of the complaints were withdrawn and the Commission sustained the other complaint. A draft Annual Public Report is attached. If approved by the Commission, it will be posted on the City's website.
Background
The Sunshine Ordinance provides the Open Government Commission shall prepare an Annual Public Report to be placed on the City's website and made generally available in printed form of alleged violations of the Sunshine Ordinance brought to the attention of the Commission in the previous calendar year. Section 2-93.6, Alameda Municipal Code. The Report is to identify the nature of the alleged violation, the relief sought, the disposition thereof and the location of all records relevant to the violation.
Discussion
During 2018, there were three complaints alleging violations of the Ordinance that were brought to the attention of the Commission. Two of those complaints, however, were withdrawn prior to the Commission's hearing the complaints. The one complaint that the Commission did hear alleged that the City Council had violated Sections 2-90.1 and 2-91.5, AMC, alleging the Council's agenda description for an item on its October 16, 2018 agenda was inadequate to inform the public about the action the Council took that evening.
The Commission considered this complaint at its meeting on November 14, 2018 and its meeting on December 17, 2018. The Commission sustained the complaint. The records relative to this complaint are on file with the City Clerk.
