EXECUTIVE SUMMARY
The building under construction at 2175 North Loop Road is a 46,000 square foot “flex” building, designed for office and light industrial businesses. The applicant/developer is requesting approval of a commercial condominium to allow the future sale of the individual tenant spaces. On January 14, 2019, the Planning Board recommended the City Council approve the tentative Parcel Map with conditions. Staff is recommending approval of the Parcel Map.
BACKGROUND
On February 12, 2018, the Planning Board adopted a resolution approving a Final Development Plan and Design Review to allow the construction of one 46,000 square foot “flex” building on a 2.81 acre parcel located at 2175 North Loop Road. On August 7, 2018, the City of Alameda issued building permits to construct the 46,000 square foot “flex” building at 2175 North Loop Road. A “flex” building offer the flexibility to tenants to use the building for office, light industrial (warehousing, manufacturing, etc.), or some combination thereof.
On January 14, 2019, the Planning Board adopted a resolution recommending approval of Parcel Map No. 10924 to allow the subdivision of the 46,000 square foot “flex” building at 2175 North Loop Road into two commercial condominium units and one common area with associated parking and landscaping improvements.
DISCUSSION
The structure under construction at 2175 North Loop Road is a “flex” building, which is a combination of office and warehouse/light manufacturing uses with two tenant spaces. The building is a “spec” building, meaning that it is being built by the applicant/developer without a specific tenant in mind. The applicant/developer has noted that potential future tenants have expressed the desire to outright purchase a tenant space, rather than leasing. To accommodate the potential future sale of a tenant space, the applicant is requesting approval of Parcel Map No. 10924 to create two commercial condominium units in the building under construction. The parking lot, landscaping and other common areas would be a separate parcel. Staff recommends as a condition of approval that the applicant/developer record Covenants, Codes, and Restrictions (CC&Rs) on the property that designate responsibility between future owners for the maintenance and upkeep of these common areas. At their January 14, 2019 regular meeting, the Planning Board modified staff’s recommendation to also require that if the CC&Rs were to include the assignment of parking spaces to individual condominium owners, that the assignment not be at a rate more than two and a half parking spaces per one thousand square feet (2.5/1,000) of floor area, which is the minimum parking standard for “flex” spaces.
FINANCIAL IMPACT
There is no impact to the General Fund since all of the improvements are private and will be constructed by the subdivider and maintained by the property owner.

This action does not affect the Municipal Code.
ENVIRONMENTAL REVIEW
In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under CEQA Guidelines section 15315, Minor Land Divisions.
RECOMMENDATION
Adopt a resolution approving Parcel Map No. 10924 - A Parcel Map for the proposed subdivision on a 2.81 acre parcel located at 2175 North Loop Road into two commercial condominium units and to create one common area parcel for associated parking and landscaping.
