EXECUTIVE SUMMARY
The City of Alameda (City) has been awarded two Community Development Block Grants (CDBG) totaling $202,315 for the Cross Alameda Trail (CAT) (Main to Constitution) project No. 91402. The City Council is asked to commit this funding to the project.
The scheduled completion date for the CAT project has been delayed until October 2019 due to a wet and extended rainy season. The extended project duration and compliance with environmental requirements will necessitate contract amendments with various consultants to complete the project.
BACKGROUND
The CAT will be a premier east-west walking and bicycling corridor across the length of the City, stretching from the Seaplane Lagoon at Alameda Point to the Miller-Sweeney Bridge at Tilden Way for a total of four miles. The development of the CAT/RAMP and Atlantic Avenue segment from Main Street to Constitution Way began in 2014. The Transportation Commission and City Council approved a final concept plan for this one-block segment in March and April 2017, respectively, and on November 7, 2018, the City Council awarded the construction contract for a total of $5,299,614.
DISCUSSION
Project construction began in late 2018 to meet funding and progress deadlines for several grants associated with the project. Unfortunately, a wet and unusually extended rainy season coupled with the challenge of finding clean fill to cover the contaminated native soils significantly delayed the initial earthwork activities. Construction progress has resumed with the end of the rainy season and the project is currently scheduled to be completed in October 2019. The project delay, additional environmental testing requirements of the Alameda County Department of Environmental Health, and effort to identify, test, and procure clean fill will exceed the authorized contract amounts for the City’s environmental and project management consultants supporting the project. Contract amendments to extend the time and increasing consultant budgets are required to complete the project.
The increase in project support costs are partially mitigated by deductive change orders to the McGuire and Hester contract. The October 2018 decision by the AC Transit Board to re-route the two bus lines that currently use the bus stop on eastbound Atlantic Avenue, just east of Webster Street, eliminated the need for the planned bus boarding island at this time or in the foreseeable future resulting in significant project savings. In addition, the project will not need the full amount included in Bid Alternative No. 1 for procurement of clean fill. As a result, staff does not expect to use the full contract contingency and has made $220,000 of contingency funding available for the increases in consultant expenses and additional staff time needed to complete the project.
ALTERNATIVES
A no action alternative would jeopardize the ability to successfully complete the project. Staff does not have the resources to sufficiently manage nor the expertise to address the environmental and regulatory requirements without consultant’s assistance.
FINANCIAL IMPACT
Budget for the project is included in the Capital Projects Fund (Fund 310), Project No. 91402, CAT (Main to Constitution), which includes $6,980,060 from 13 different fund sources. Sufficient funding is available in the project budget to approve the contract amendments (see Exhibits 3, 5, 7 & 9). (See Exhibits 1, 2, 4, 6, & 8 for prior agreements.)

ENVIRONMENTAL REVIEW
In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt pursuant to CEQA Guidelines section 15301(c) - Existing Facilities and 15304(b) - Minor Alterations to Land and 15304(h). In accordance with the National Environmental Policy Act, this project is a Categorical Exclusion under 23 Code of Federal Regulations 771.117(c): activity (c)(3) - Construction of bicycle and pedestrian lanes, paths and facilities.
CLIMATE IMPACTS
Construction of enhanced bicycle and pedestrian facilities will encourage Alamedans and visitors to walk and bicycle more, potentially reducing greenhouse gas emissions from vehicle miles traveled.
RECOMMENDATION
Authorize the City Manager to execute Amendment to Agreements with Tetra Tech, Ninyo & Moore, BKF Engineers, and Park Engineering for the Cross Alameda Trail (Main to Constitution) project, in a cumulative amount, including contingency, not to exceed $115,770.
CITY MANAGER RECOMMENDATION
The City Manager recommends approval of an amendment to the contract not to exceed $115,770.
