EXECUTIVE SUMMARY
The City of Alameda (City) median strips and special areas require constant attention to ensure the landscape is maintained to City standards. Public Works went out to bid for this work, and when the bids were opened, the department received a bid protest. After reviewing the protest, Public Works is requesting the City Manager reject all bids and call for rebid of the project.
BACKGROUND
The City is in need of services from an outside organization to help with its landscape maintenance of median strips and special areas. The work consists of general landscape maintenance, irrigation repairs, and weed abatement at 90 locations throughout the City.
DISCUSSION
In July 2019, the Public Works Department sent out a Request for Bids (RFB) for Citywide landscape maintenance of median strips and special areas. To solicit the maximum number of bids and most competitive price, the RFB was provided to 19 separate builders’ exchanges throughout the Bay Area, and notices were sent to contractors on the list of qualified contractors maintained by the Public Works Department. The RFB was also placed on the City’s website, and a notice was published in the Alameda Journal. After a bidding period of 22 days, two contractors submitted bids. The bids were opened on July 22, 2019. The bid results are as follows:

Enviroscapes Landscape Services, Inc. filed a bid protest stating that their timely-provided inquiries during the bid process were not properly responded to. After reviewing the facts, Public Works found some merit in the protest and, in an abundance of caution, requests the City Council’s rejection of all bids and call for rebid.
ALTERNATIVES
• The City Council can authorize the City Manager to reject all bids and call for rebid for Citywide landscape maintenance of median strips and special areas.
• The City Council could take no action at this time.
FINANCIAL IMPACT
The funds for this project are budgeted in the Public Works Department’s account for Capital Improvement Program (Project No. 96002) for Citywide landscape maintenance of median strips and special areas with monies from the Capital Improvement Fund (Fund 310). There is no impact to the General Fund.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action does not affect the Alameda Municipal Code.
ENVIRONMENTAL REVIEW
In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt pursuant to CEQA Guidelines Section 15301(c), Existing Facilities.
CLIMATE IMPACTS

RECOMMENDATION
Authorize the City Manager to reject all bids and call for rebid for Citywide landscape maintenance of median strips and special areas, No. P.W. 06-19-28.
CITY MANAGER RECOMMENDATION
The City Manager requests that the City Council reject all bids and call for rebid.
