EXECUTIVE SUMMARY

 

The Alameda Police Department’s (Department) Marine Patrol Unit has the capacity to protect and serve the critical waterfront surrounding and adjacent to the island of Alameda. In 2015, the Department’s Marine Patrol Unit purchased a marine patrol boat using grant funds received from the State. That boat is now ill-equipped to handle the rougher waters that are anticipated, given the modified mission of the coalition of law enforcement agencies, which the Department’s Marine Patrol Unit is a member, that patrol the waterways of the Alameda/Oakland area. This spring, the Department applied for a FEMA grant to finance a new patrol boat, and was awarded a grant in September.

 

The Department conducted a competitive bid process and is now prepared to recommend an award to Safe Boats International, who would supply a durable police boat that is better equipped to handle the rough waterways of the Alameda/Oakland area, in addition to meeting other objectives.

 

BACKGROUND

 

The Department purchased a patrol boat in 2015 after entering into a grant agreement with the State of California, Division of Boating and Waterways (DBW).  The terms and conditions of that contract were to remain in effect for 15 years starting September 14, 2014.  The patrol boat has been utilized to patrol the City of Alameda (City) waterways for the past five years.  During that time, costs to maintain the boat have increased significantly and the mission of the Department’s Marine Patrol Unit has shifted from patrolling in the Alameda/Oakland estuary to the greater Bay waters outside of the estuary. The Department’s Marine Patrol Unit are now members of the Neptune Coalition and the Bay Area Maritime Security Committee, a coalition of Bay Area Law Enforcement Agencies that coordinate to enhance the safety and security of the Ports within the Bay Area and the Delta.  The current boat is not properly constructed to safely patrol rougher portions of the waterways, and in order to effectively perform services, such as water rescues, rescue boat operations and mutual aid in much rougher waterways, a new patrol boat needs to be purchased.

 

The Department needs the capacity to protect and serve the critical waterfront surrounding and adjacent to the island of Alameda.  This critical waterfront includes the Port of Oakland, US Coast Guard Base Alameda, Oakland International Airport, the USS Hornet Museum, the Ready Reserve Fleet at the former Alameda Naval Air Station, the Alameda/Oakland Estuary, two ferry terminals with a third terminal under construction, and the marinas in Alameda and Oakland.  Routine marine patrol would place an emphasis on public safety, boating safety, search and rescue, and crime prevention.  Marine patrol officers would enforce regulations on the waterways, which include boating under the influence, abandoned vessels and wake zone enforcement.  Additionally, they would assist disabled vessels, respond to vessels in distress, investigate boat collisions, and respond to water rescue incidents.

 

DISCUSSION

 

In April 2019, the Department completed a grant application with FEMA, requesting funding for the purchase of the new patrol boat and trailer with an estimated acquisition cost of $487,477.  On September 1, 2019, FEMA awarded the Department $365,608 toward this purchase. The grant requires a cost match of $121,869 of non-federal funds, or 25% of the total approved costs.  The Department will be using the State Citizens’ Option for Public Safety (COPS) grant to satisfy the federal grant matching requirement. The Department is asking the City Council to adopt a resolution accepting a grant from FEMA.  Prior to the acceptance of the grant, a request for bid was posted on the City’s website.  The bidding closure date was September 30, 2019.

 

To solicit the maximum number of bids and most competitive price, plans and specifications were provided throughout the Bay Area, United States and Canada.  A notice was published in the Alameda Journal on September 5, 2019.  After the bidding period of 25 days, only one contractor submitted a bid, and that bid was opened on October 1, 2019.  The bid result for the new Patrol Boat and Trailer is as follows:

Staff contacted three references provided by the bidder and received positive feedback about the quality and timeliness of their work.  Staff recommends awarding a contract to Safe Boats International for $460,673.13.

 

The project specifies that the completed boat and trailer must be delivered to the Department by August 20, 2020.

 

ALTERNATIVES

 

                     Accept the grant and move forward with the purchase of the new Patrol Boat and Trailer, which will enhance and improve the capabilities of the Department’s Marine Patrol Unit.

 

                     Decline the grant and stay status quo.

 

FINANCIAL IMPACT

 

The total not to exceed cost, as stated in the federal grant application, is $487,477.  Based on the bid received, the total cost for the new marine patrol boat and trailer is $460,673.13 ($415,716.75 for the marine patrol boat and trailer, $40,532.38 for the State of California sales tax and $4,424.00 of shipping costs). The funding source for the purchase of the patrol boat and trailer is State Citizens’ Option for Public Safety (COPS) in the amount of $115,168.29 (non-federal match) and FEMA 2019 Port Security Grant #EMW-2019-PU-00247 (CFDA No. 97.056) in the amount of $365,608.

The COPS grant has been previously budgeted and there are sufficient appropriations available for the non-federal match.  However, the Port Security Grant is a newly allocated funding and requires an increase in revenue and expenditure appropriations.  The budget for the grant will be included in Police Grants Fund (#218).

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

There is no impact on the Alameda Municipal Code from this action.

 

ENVIRONMENTAL REVIEW

 

This action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines sections 15061(b)(3) (common sense exemption) and 15321 (law enforcement activities).

 

CLIMATE IMPACTS

 

It is anticipated that the additional airborne noise created by the Safe Boat would be indistinguishable from existing vessel activity and ambient noise in the Alameda/ Oakland waterways.  Minor adverse noise impacts could occur in the area during unusual events (e.g., high-speed pursuits), depending on the location of the event relative to the location of sensitive noise receptors.  The potential for such impacts would be minimized by the use of four-stroke engines on the Safe Boats.  Minor direct noise impacts on human health and welfare could result from the Proposed Action under- normal operating conditions.

 

RECOMMENDATION

 

It is recommended that the City Council approve the following actions:

 

Authorize the City Manager, or His Designee, to Enter into an Agreement with the Federal Emergency Management Agency (FEMA), to Accept and Allocate Fiscal Year 2019 Port Security Grant Program Funds in the Total Amount of $365,608;

 

Award a Bid Contract to the Sole Bidder to Build and Provide a New Marine Patrol Boat and Trailer in the Amount not to Exceed $487,477 to Safe Boats International; and

 

Adopt a Resolution Amending Fiscal Year 2019-20 Police Grants Fund Revenue and Expenditures Budget in the Amount of $365,608 for the Port Security Grant, which is a Reimbursement Grant.
