EXECUTIVE SUMMARY

 

The construction schedule for the Cross Alameda Trail (CAT) project has been extended and will necessitate an agreement with Tetra Tech for post construction project closeout [Exhibit 1] and a Second Amendment to the Agreement with BKF Engineers [Exhibits 2, 3 and 4] and a Second Amendment to the Agreement with Park Engineering [Exhibits 5, 6 and 7] for additional funding in light of an extended date of completion for the project.  The completion date needs to be extended until February 2020 due to inclement weather, limited contractor resources as a result of a very busy construction season, and the City’s adding a significant amount of extra work.  The extra work, not anticipated in the original plans, includes improving the existing storm drain and sanitary sewer manholes to mitigate their aged condition and to meet the new final finish grades. The extended project duration and compliance with environmental requirements will necessitate contract amendments with two consultants and a new contract with a third consultant.  Sufficient funding is available in the project budget to approve the contract amendments and the new contract.

 

BACKGROUND

 

The CAT will be a premier east-west walking and bicycling corridor across the length of Alameda, stretching from the Seaplane Lagoon at Alameda Point to the Miller-Sweeney Bridge at Tilden Way, for a total of four miles. The development of the CAT/Ralph Appezzato Memorial Parkway (RAMP) and Atlantic Avenue segment from Main Street to Constitution Way began in 2014. The Transportation Commission (TC) and City Council approved a final concept plan for this one-block segment in March and April 2017, respectively, and on November 7, 2018, the City Council awarded the construction contract in the amount of $5,299,614. In November 2018, Council approved a contract with BFK Engineering for civil engineering and land surveying in the amount of $274,378 and a contract with Park Engineering in July 2018 for construction management in the amount of $261,544.  Those contracts were amended in July 2019 and increased by $25,000 (BFK) and $17,500 (Park) because the construct schedule had been extended and additional services of the consultants were required.  ,

 

DISCUSSION

 

Project construction began in late 2018 to meet funding and progress deadlines for several grants associated with the project. An extended rainy season coupled with the challenge of finding clean fill to cover the contaminated native soils significantly delayed the initial earthwork activities. Construction resumed with the end of the rainy season and the project was scheduled to be completed in October 2019.  This current project delay, together with complying with the requirements of the Alameda County Department of Environmental Health for post-Construction Long-Term Site Management and Annual Reporting, will exceed the authorized contract amounts for the civil engineering, land surveying and construction management team-- - BFK Engineering and Park Engineering - supporting the project. Contract amendments to increase these consultant’s compensation are required because additional services are necessary to complete the project

 

The stand-alone, five-year agreement with Tetra Tech, in the cumulative amount of $50,633, is specifically for post-construction project closeout and compliance with the Alameda County Department of Environmental Health requirements, which includes a Long-Term Site Management Plan (providing guidance and protocols to ensure the soil remediation performs as designed to protect human health in perpetuity), and conducting semi-annual site inspections and providing annual reports - for a period of five years - to ensure compliance with the Long-Term Site Management Plan.

FINANCIAL IMPACT

 

Budget for the project is included in the Public Works Capital Improvement Projects Fund (Fund 310), Project No. 91402, Cross Alameda Trail (Main to Constitution), which includes $6,980,060 from 13 different funding sources.  Sufficient funding is available in the project budget to approve the contract and contract amendments. There is no impact to the General Fund beyond previously approved funding of $771,000.

ENVIRONMENTAL REVIEW

 

In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt pursuant to CEQA Guidelines section 15301(c) - Existing Facilities and 15304(b) - Minor Alterations to Land and 15304(h).  In accordance with the National Environmental Policy Act, this project is a Categorical Exclusion under 23 Code of Federal Regulations 771.117(c): activity (c)(3) - Construction of bicycle and pedestrian lanes, paths and facilities.

 

CLIMATE IMPACTS

 

Construction of enhanced bicycle and pedestrian facilities will encourage residents and visitors to walk and bicycle more, potentially reducing greenhouse gas emissions from other modes of transportation. Building additional bicycle and pedestrian improvements is consistent with the Climate Action and Resiliency Plan (CARP):

 

T2. Build additional bike lanes. Expand TCP project/programs by adding more dedicated and protected bike lanes and making pedestrian/bicycle improvements that increase safety, make it easier for people to use these modes, and connect residential neighborhoods with commercial centers and workplaces.

 

RECOMMENDATION

 

Authorize the City Manager to execute an agreement with Tetra Tech, Inc. and second amendments to agreements with BKF Engineers and Park Engineering, for the cross Alameda trail (Main Street to Constitution Way) project, in a cumulative amount not to exceed $145,633.

 

CITY MANAGER RECOMMENDATION

 

 The City Manager recommends approval to execute an agreement with Tetra Tech, Inc. and an amendment with BKF Engineers and Park Engineering in an amount not to exceed $145,633.
