Consider Providing Direction to Staff on Handling Late Rent Payments.
The City is landlord for several residential and commercial properties. To avoid the potential for extended periods of unpaid rents, this referral requests that the Council give direction to City staff on a process for handling overdue rents.
Suggested Policy:
• Three-Day Notice to Pay or Quit should be served on the first day available (i.e., after rent is overdue, or after expiration of any grace period);
• For any commercial tenancies, Unlawful Detainer actions should be filed immediately upon the expiration of the three-day notice, without need for Council approval;
• For any residential tenancies, City Council must approve any filing of an Unlawful Detainer action; and
• City Attorney’s Office should be promptly informed of any tenants who are late paying rent.
