EXECUTIVE SUMMARY
The City of Alameda (City) has received private party interest in leasing Building 14 at Alameda Point. The inquiry initiates the need to identify real property negotiators to represent the City in connection with such prospective negotiations. As such, staff is recommending that the City Council designate City Manager Levitt, Assistant City Attorney Maxwell, Community Development Director Potter, and Assistant Community Development Director Mocanu, as the real property negotiators, which will allow them to meet with the City Council in closed session to discuss price, terms and conditions related to the possible lease, offer Building 14 for lease in a manner compliant with all applicable laws, and represent the City in negotiations with a public or private party.
BACKGROUND
Building 14, containing approximately 31,394 rentable square feet and located at 1800 Ferry Point on Alameda Point, is currently leased to Navigator Systems. Navigator Systems has leased the premises since August 1, 1997.
The current lease agreement was entered on December 1, 2013, with Navigator Systems for Building 14 with a term of 84 months (seven years), plus one five-year extension option, for use as an incubator environment to provide productive, collaborative and promotional facilities for designers, craft workers, artists, engineers, musical instrument restoration specialists and light artisanal manufacturing.
Pursuant to the terms of the current lease, Navigator Systems has delivered to the City a notice exercising its one five-year extension option, which extends the term of the lease from November 30, 2020 to November 30, 2025.
DISCUSSION
Under California Government Code Section 54956.8, the City Council must identify the real property negotiators for negotiation of the terms, price and conditions concerning real property, such as Building 14. Staff recommends that the negotiators be Eric Levitt, City Manager, Lisa Maxwell, Assistant City Attorney, Debbie Potter, Community Development Director, and Nanette Mocanu, Assistant Community Development Director, for the potential leasing of Building 14. This will allow City Manager Levitt, Assistant City Attorney Maxwell, Community Development Director Potter, and Assistant Community Development Director Mocanu, to negotiate on the City’s behalf, based on direction provided by the City Council.
ALTERNATIVES
• Approve Eric Levitt, Lisa Maxwell, Debbie Potter, and Nanette Mocanu as real property negotiators for the potential leasing of Building 14.
• Identify other staff as negotiators.
• Choose not to negotiate the potential lease of Building 14.
FINANCIAL IMPACT
There is no financial impact from the approval of real property negotiators.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action has no effect on the Alameda Municipal Code.
ENVIRONMENTAL REVIEW
Approval of real property negotiators is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301, as topic at hand involves the negotiation of the possible lease of property.
CLIMATE IMPACTS
This action has no climate impacts.
RECOMMENDATION
Approve Eric Levitt, City Manager, Lisa Maxwell, Assistant City Attorney, Debbie Potter, Community Development Director, and Nanette Mocanu, Assistant Community Development Director, as real property negotiators for the potential leasing of Building 14 at 1800 Ferry Point on Alameda Point.
CITY MANAGER RECOMMENDATION
The City Manager requests approval of the Real Property Negotiators.
