AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A THIRD AMENDMENT TO THE LICENSE AGREEMENT WITH AMBER KINETICS, INC., A CALIFORNIA CORPORATION, FOR USE OF THE UNIMPROVED LOT LOCATED AT 641 WEST RED LINE AVENUE IN ALAMEDA EXTENDING THE TERM FOR 12 MONTHS AND PROVIDE ONE 12-MONTH EXTENSION OPTION
WHEREAS, Amber Kinetics is a California corporation that manufactures energy storage technology; and
WHEREAS, in 2014, the City of Alameda entered into a license agreement with Amber Kinetics, Inc. for the approximately 10,000 square foot unimproved lot located at 461 West Red Line Avenue in Alameda, for use as a test site for electrical systems storage; and
WHEREAS, the term of the license agreement was twenty-four (24) months and established a base monthly rent at $1,000.00; and
WHEREAS, in 2016, the City approved a first amendment to the license agreement extending the term of the agreement for twenty-four (24) months and increasing the monthly base rent to $2,200.00; and
WHEREAS, in 2018, the City approved a second amendment to the license agreement extending the term of the agreement for an additional twenty-four (24) months and increasing the monthly base rent to $3,600.00; and
WHEREAS, the City and Amber Kinetics now desire to enter into a third amendment to the license agreem...
