EXECUTIVE SUMMARY
Tract 8336 subdivided 21.35 acres of land located at Site A, Phase 1, Alameda Point creating twelve parcels and remainder parcels. Alameda Point Partners completed a portion of the improvements, as detailed in the table below and staff is recommending that the City Council accept them as completed and reduce the amount of the surety.
BACKGROUND
On July 20, 2016, the City Council approved Tentative Map Tract 8336 per City of Alameda (City) Resolution No. 15187. On March 7, 2017, the City Council established Community Facilities District No.17-1 (Alameda Point Public Services District) to levy special taxes and fees for City-provided municipal services to Site A. On March 21, 2017, the City Council adopted Resolution No. 15244 approving the first final map and bond for Site A, Phase 1, authorizing the execution of a Public Improvement Agreement (PIA) with Alameda Point Partners, and rejecting the offers of dedications and easements for Tract 8336. The offers of dedication remain open until accepted by the City Council.
DISCUSSION
The public improvements for Tract 8336 at Site A, Phase 1 at Alameda Point development are comprised of 9 infrastructure sub-phases in accordance with Exhibit C of the PIA for the project dated March 21, 2017.
Staff recommends the acceptance of the following completed public improvements:

The following exceptions apply to Sub-Phases 6 and 8. All other sub-phases are otherwise complete:
Sub-Phase 6, Secondary Streets and Utilities:
• All streetlights adjacent to Blocks 6, 7, 8, and 9 are not recommended for acceptance due to ongoing block construction that has damaged multiple streetlights.
• Sidewalk and frontage improvements adjacent to Block 9 on Orion Street, Coronado Avenue, and Ardent Way frontages are not complete.
Sub-Phase 8, Waterfront Park:
• The park is not complete and is not part of this recommendation for acceptance of improvements.
Alameda Point Partners provided surety for the public improvements for Tract 8336 with a Performance Bond and Labor and Materials Bond each in the amount of $42,900,844.00. Following the acceptance of the completed improvements listed above, the Performance Bond and Labor and Materials Bond will each be reduced to $5,546,296.00 as a surety of the remaining work. Per the PIA, Alameda Point Partners will provide a warranty bond in the amount of 10% of the work completed.
Construction of the public improvements for Tract 8336, with the exceptions of the items noted above for Sub-Phases 6 and 8, are in pursuant to the PIA and its terms and conditions has been completed by Alameda Point Partners. The completed work is acceptable to the Public Works Department.
ALTERNATIVES
• Accept the improvements completed by Alameda Point Partners for Tract 8336 at Site A, Phase 1, at Alameda Point, as recommended.
• Remand the project back to staff for further consideration and evaluation of the completed improvements.
FINANCIAL IMPACT
All listed tract improvements were constructed by Alameda Point Partners. Parcels within the tract are or will be assessed ad valorem property taxes and other City-wide property related fees. Per the City’s Policy of Fiscal Neutrality, costs of City municipal services in excess of those covered by ad valorem property taxes and City-wide property related fees will be paid for by taxes levied from Community Facilities District No.17-1 (Alameda Point Public Services District).
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action does not affect the Alameda Municipal Code.
ENVIRONMENTAL REVIEW
Per City Resolution No. 14891, the City Council certified the Final Alameda Point Environmental Impact Report (FEIR) (State Clearinghouse No. 201312043) under the California Environmental Quality Act (CEQA), California Public Resources Code Section 21000 et seq. and adopted written findings and a Mitigation Monitoring and Reporting Program (MMRP) on February 4, 2014, for the Alameda Point Project, including the Town Center Plan area which contains Site A.
RECOMMENDATION
Authorize the City Manager to accept the improvements completed by Alameda Point Partners, for Tract 8336 Site A, Phase 1, at Alameda Point.
