EXECUTIVE SUMMARY

 

The gymnasium (gym) at Alameda Point is a heavily utilized recreational facility that often hosts large tournaments and events on weekends.  The gym’s existing restrooms are insufficient for the volume of people attending these events.  Beginning with the Fiscal Year (FY) 2015-17 capital budget, the City of Alameda (City) established the Alameda Point Modular Restroom Building (APMRB) Capital Improvement Project (CIP) and budgeted funds to provide a new eight-unit modular restroom building immediately adjacent and accessible to the gym. The City will reduce the cost and timeline of this project by separately procuring the modular building through a cooperative purchasing agreement and providing the building to a general contractor for install and configuration.  Staff is seeking approval to purchase the building from CXT Inc., who holds a competitively solicited contract with Sourcewell, a cooperative purchasing agency the City is a member of, and to enter into contract with NBC Construction & Engineering, Inc. for installation.  Current available funding in the Alameda Point Modular Restroom Building project budget is insufficient to cover costs. Staff recommends transferring available funds from the Officer’s Club Improvements project budget to cover the proposed project expenses.

 

BACKGROUND

 

The gym at Alameda Point requires additional restroom facilities for gym users.  This new modular restroom building will be located adjacent to the gym (on the parking lot side), will be secured with a fenced breezeway enclosure, which will also be Americans with Disability Act (ADA) accessible.  The building will also serve skate park users with two exterior facing restrooms located outside of the breezeway enclosure.

 

DISCUSSION

 

Staff seeks approval to pre-purchase the modular restroom building under the contract held between Sourcewell/NJPA, a cooperative purchasing agency that the City is a member of, and CXT, Inc. in an amount not to exceed $225,941.35 (contingency of $10,760), which includes design, permits, production, delivery, and assembly on-site. A purchase payment of $215,181.35 is to be made within 30 days after the installation and acceptance of the building.  This purchase is consistent with City’s Purchasing Policy through Administrative Policies and Procedures #5.  CXT, Inc. is not guaranteed any of the contingency amount and the use of the contingency will be at the sole discretion of the City for work not originally anticipated.  The contract and price quote are attached as Exhibit 2.

 

Installation of the modular restroom and associated site improvements requires the services of a contractor. To solicit the maximum number of bids and most competitive price, plans and specifications were provided to 16 separate builders’ exchanges throughout the Bay Area.  In addition, notices were placed on the City’s webpage and published in the Alameda Journal on January 14, 2021.  After a bidding period of 21 days, six contractors submitted bids.  Bids were opened on February 4, 2021, with the following results:

Public Works staff contacted references provided by the lowest responsive bidder and received positive feedback on the ability of the company to meet the project requirements and the quality and timeliness of their work. Staff recommends awarding a contract to NBC Construction & Engineering, Inc. for a total amount of $336,580, which includes a 9% contingency in the amount of $27,792.  The contractor is not guaranteed any of the contingency amount and the use of the contingency will be at the sole discretion of the City for work not originally anticipated in the plans and specifications.  The contract is attached as Exhibit 1.

                     Award the project as presented.

                     Direct staff to adjust the amount of work in this project.

                     Do not award the project and provide different direction to staff.

 

FINANCIAL IMPACT

 

As of February 16, 2021, the Officer’s Club Improvements CIP (960093) has available budget of $388,533.46. Staff is requesting to transfer $361,000 of the remaining $388,533.46 budget in CIP 960093 to the Alameda Point Modular Restroom Building CIP (91857706), which will result in $702,562.77 in available budget in CIP 91857706 to complete this project. The funding sources for CIP 91857706 are the Facilities Replacement Fund (Fund 706) and the General Fund (Fund 001).

ENVIRONMENTAL REVIEW

 

In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt pursuant to CEQA Guidelines Section 15301(c), Existing Facilities, 15302 Replacement or Reconstruction, and 15303 New Construction of Small Structures.

 

CLIMATE IMPACTS

 

The Alameda Point modular restroom building project is an all-electric building without natural gas service connections. Natural gas use from buildings is one of the larger emission sources of greenhouse gas emissions (GHG).  The City’s Climate Action and Resiliency plan recommends the electrification of buildings to reduce GHG emissions.

 

RECOMMENDATION

 

Authorize the City Manager to pre-purchase a modular restroom building from CXT, Inc. in a not to exceed amount of $225,941.35; and

Authorize the City Manager to execute an agreement with NBC Construction & Engineering, Inc. for Alameda Point modular restroom building, No. P.W. 09-20-36, in a not to exceed amount of $336,580; and

Amend the Fiscal Year 2019-21 Capital Budget by reducing revenue and expenditure appropriations in Capital Improvement Program 960093 by $361,000 and increasing revenue and expenditure appropriations for Capital Improvement Program 91857706 by $361,000.

 

CITY MANAGER RECOMMENDATION

 

The City Manager recommends approval to pre-purchase a modular restroom building and to execute an agreement with NBC Construction and Engineering for Alameda Point modular restroom building.
