EXECUTIVE SUMMARY
The installation of a new outfield fence at Lincoln Park between the baseball field and residences along Central Avenue initiated the need to identify real property negotiators to represent the City of Alameda (City) in connection with prospective negotiations for a solution. As such, staff is recommending that the City Council designate City Manager Levitt, Director Wooldridge and Chief Assistant City Attorney Mackenzie, as the real property negotiators, which will allow them to meet with City Council to discuss price, terms and conditions related to a possible grant of a revocable license for a certain section of land between the new fence and property line at 1450 High Street, Alameda in a manner compliant with all applicable laws and represent the City in negotiations with a public or private party.
BACKGROUND
The City is the owner of Lincoln Park at 1450 High Street. For safety and security reasons, the Alameda Recreation and Parks Department (ARPD), installed a new 50-foot fence between the baseball field and 9 residential properties along Central Avenue. Due to the size of the footings required for the fence, as well as to maintain security for the neighbors during construction, the new fence is located one to three feet further into the park from the original fence line. This created a certain section of land that is to be discussed.
DISCUSSION
Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, the City Council must identify the real property negotiators for negotiation of the terms, price and conditions concerning real property, such as the certain section of land in Lincoln Park at 1450 High Street in Alameda. Staff recommends that the negotiators be Eric Levitt, City Manager, Amy Wooldridge, Recreation and Parks Director and Elizabeth Mackenzie, Chief Assistant City Attorney, for a potential grant of a revocable license for a certain section of land between the new fence and resident property line at 1450 High Street. This will allow City Manager Levitt, Director Wooldridge and Chief Assistant City Attorney Mackenzie, to negotiate on the City’s behalf, based on direction provided by the City Council.
ALTERNATIVES
• Approve Eric Levitt, Amy Wooldridge and Elizabeth Mackenzie as real property negotiators for a potential grant of a revocable license for 1450 High Street;
• Identify other staff as negotiators; or
• Choose not to negotiate the potential grant of a revocable license for 1450 High Street.
FINANCIAL IMPACT
There is no financial impact from the approval of real property negotiators.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action is consistent with the Alameda Municipal Code.
ENVIRONMENTAL REVIEW
Approval of real property negotiators is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301, as topic at hand involves the negotiation of the possible lease of property.
CLIMATE IMPACT
There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.
RECOMMENDATION
Approve Eric Levitt, City Manager, Amy Wooldridge, Recreation and Parks Director and Elizabeth Mackenzie, Chief Assistant City Attorney, as Real Property Negotiators for the Potential Grant of a Revocable License for 1450 High Street in Alameda.
