EXECUTIVE SUMMARY

Staff is recommending that City Council designate: Eric Levitt, City Manager; Gerry Beaudin, Assistant City Manager, Lisa Maxwell, Community Development Director; and Louis Liss, Base Reuse Manager as negotiators with the Navy related to the former Naval Air Station (“Alameda Point”).

 

BACKGROUND

 

In 2000, the Alameda Reuse and Redevelopment Authority entered into a Memorandum of Agreement (“MOA”) and a Lease in Furtherance of Conveyance (“LIFOC”) with the Federal Government, acting through the Department of the Navy (the “Navy”), which covered the Economic Development Conveyance (“EDC”) of Alameda Point. The MOA was amended in 2001 and 2012. Staff has begun discussions with the Navy about a potential additional amendment to existing terms of the property disposition at Alameda Point.

 

DISCUSSION

 

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council must identify its negotiators, which are recommended to be Eric Levitt, City Manager; Lisa Maxwell, Community Development Director; and Louis Liss, Base Reuse Manager.

 

ALTERNATIVES

 

City Council may:

 

                     Approve Eric Levitt, Gerry Beaudin, Lisa Maxwell, and Louis Liss, as the negotiators with the Navy related to Alameda Point;

                     Identify other staff as negotiators; or

                     Choose not to negotiate with the Navy regarding Alameda Point at this time. 

 

FINANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

 

 

MUNICIPAL CODE/POLICY CODUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.

 

SURPLUS LANDS ACT

 

The Surplus Lands Act, as amended by AB1486 (2019), does not apply to the negotiation with the Navy related to Alameda Point because the property is subject to legally binding agreements that were entered into prior to September 30, 2019.  See Government Code Section 54234(a).

 

ENVIRONMENTAL REVIEW

 

Approval of real property negotiators is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301, as topic at hand involves the negotiation of the possible lease of property.

 

CLIMATE IMPACTS

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

 

RECOMMENDATION

 

Approve Eric Levitt, City Manager Gerry Beaudin, Assistant City Manager,; Lisa Maxwell, Community Development Director; and Louis Liss, Base Reuse Manager, as Designated Negotiators with the Navy related to Alameda Point.

 

CITY MANAGER RECOMMENDATION

 

The City Manager requests approval of the recommended designated negotiators with the Navy.
