EXECUTIVE SUMMARY

A portion of a public utility easement at 2450 Mariner Square Loop is no longer needed following the installation of a new transformer and corresponding ducts with its own easement. The current owners of the parcel have requested that the City of Alameda (City) vacate and quitclaim the portion of the easement to them.

BACKGROUND

On December 16, 2004, Limar Realty Group granted a public utility easement to the City for installation and maintenance of utilities for the benefit of Alameda Municipal Power (AMP). The easement was recorded and filed in the Office of County of Alameda Recorder on December 30, 2004. The need for a portion of this easement was negated when a new transformer and corresponding ducts were installed nearby with its own easement. The current owners of the parcel have requested that the City vacate and quitclaim the portion of the easement to them as the easement is no longer being used as it was originally intended.

DISCUSSION

The Quitclaim Deed is attached as Exhibit 2 to the Staff Report and as Exhibit 1 to the Resolution. Alameda Municipal Power and City Attorney's Office staff have reviewed the document. and are satisfied with the contents therein.

ALTERNATIVES

City Council can:

* Adopt the resolution; or
* Reject the resolution.

FINANCIAL IMPACT

There is no financial impact to the City as a result of this action. The property owner has paid all costs associated with the termination. There is no impact to the General Fund.

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

This action is consistent with the Alameda Municipal Code.
