EXECUTIVE SUMMARY

 

Staff is recommending that City Council designate City Manager, Eric Levitt, Community Development Director, Lisa Maxwell, Chief Assistant City Attorney, Elizabeth Mackenzie, and Assistant Community Development Director, Nanette Mocanu, as the real property negotiators for Building 163, located at 1800 Orion Street, Suite 100, and Building 414, located at 1820 Orion Street, Alameda, which will allow them to meet with City Council in closed session to discuss terms related to occupancy of these properties in a manner compliant with all applicable laws (including the Surplus Lands Act) and to represent the City of Alameda (City) in negotiations with a public or private party.

 

BACKGROUND

 

Sustainable Technologies (Tenant) is a tenant at Alameda Point located in Buildings 163 and 414 (collectively, Premises). Staff is seeking City Council direction regarding the existing month-to-month tenancy of those buildings in consideration of concerns raised by the U.S. Navy (“Navy”) and regulators regarding indoor air sampling in the Premises, as well as the cost of related monitoring and mitigation.

 

Staff is recommending that City Council designate City Manager Eric Levitt, Community Development Director Lisa Maxwell, Chief Assistant City Attorney Elizabeth Mackenzie, and Assistant Community Development Director Nanette Mocanu, as the real property negotiators for Building 163, located at 1800 Orion Street, Suite 100, and Building 414, located at 1820 Orion Street, Alameda which will allow them to meet with City Council in closed session to discuss terms for these properties in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

 

DISCUSSION

 

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, the City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as Buildings 163 and 414. Staff recommends that the negotiators for negotiations related to these properties include Eric Levitt, City Manager; Lisa Maxwell, Community Development Director, Elizabeth Mackenzie, Chief Assistant City Attorney, and Nanette Mocanu, Assistant Community Development Director. This will allow those individuals to negotiate on the City’s behalf, based on direction provided by the City Council.

ALTERNATIVES

 

                     Approve Eric Levitt, Lisa Maxwell, Elizabeth Mackenzie, and Nanette Mocanu as real property negotiators for Buildings 163 and 414.

                     Identify other staff as negotiators.

                     Choose not to negotiate terms related to occupancy of Buildings 163 and 414, and thus do not identify negotiators.

 

FINANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

Approval of real property negotiators is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301, as it involves the negotiation of the price and terms of a lease.

 

CLIMATE IMPACTS

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

Approve Eric Levitt, City Manager, Lisa Maxwell, Community Development Director, Elizabeth Mackenzie, Chief Assistant City Attorney, and Nanette Mocanu, Assistant Community Development Director, as Real Property Negotiators for Building 163, located at 1800 Orion Street, Suite 100, and Building 414, located at 1820 Orion Street, Alameda, CA 94501.

 

CITY MANAGER RECOMMENDATION

 

The City Manager requests approval of the recommended negotiators.
