EXECUTIVE SUMMARY
Staff is recommending that City Council designate: Eric Levitt, City Manager; Nico Procos, Alameda Municipal Power General Manager; Erin Smith, Public Works Director; Alan Cohen, Assistant City Attorney; and Alan Harbottle, Senior Energy Resources Analyst, as negotiators with NextEra Energy Resources related to Doolittle Landfill.
BACKGROUND
In 2018, the Public Utilities Board (PUB) approved Alameda Municipal Power’s (AMP’s) participation in the Northern California Power Agency’s (NCPA’s) Solar Project to help participating municipal utilities evaluate local solar opportunities and solicit competitive bids. AMP moved forward with the Doolittle Landfill site as the most suitable location for a medium-sized array. AMP staff engaged with a third-party engineering firm to create a Site Plan Development [2019], which was the basis for a competitive solicitation, California Environmental Quality Act (CEQA) study [2020], and Use Permit [2020]. AMP staff worked closely with the Planning, Public Works, and Recreation and Parks Departments and made presentations at the Recreation and Parks Commission, Golf Commission, and Planning Board.
DISCUSSION
Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council must identify its negotiators, which are recommended to be Eric Levitt, City Manager; Nico Procos, Alameda Municipal Power General Manager; Erin Smith, Public Works Director; Alan Cohen, Assistant City Attorney; and Alan Harbottle, Senior Energy Resources Analyst.
ALTERNATIVES
City Council may:
• Identify other staff as negotiators; or
• Choose not to negotiate with the NextEra regarding Doolittle Landfill at this time.
FINANCIAL IMPACT
There is no financial impact from the approval of real property negotiators.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action is consistent with the Alameda Municipal Code.
SURPLUS LANDS ACT
The Surplus Lands Act, as amended by AB1486 (2019), does not apply to the negotiation with NextEra related to Doolittle Landfill because the property is planned to be used for City use as a utility site. See Government Code Section 54221(c).
ENVIRONMENTAL REVIEW
Approval of real property negotiators is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301, as topic at hand involves the negotiation of the possible easement of property.
CLIMATE IMPACT
Solar at Doolittle landfill is a climate action opportunity to add local, renewable energy to AMP’s portfolio of power resources.
RECOMMENDATION
Approve Eric Levitt, City Manager; Nico Procos, Alameda Municipal Power General Manager; Erin Smith, Public Works Director; Alan Cohen, Assistant City Attorney; and Alan Harbottle, Senior Energy Resources Analyst, as Designated Negotiators with the Navy related to Alameda Point.
CITY MANAGER RECOMMENDATION
The City Manager requests approval of the recommended negotiators with NextEra Energy Resources.
