EXECUTIVE SUMMARY

 

The City of Alameda (City) has nine labor groups and administers two compensation plans. This includes four Public Safety groups and five miscellaneous groups. In 2020, the City reached an agreement on a contract extension with the International Association of Firefighters (IAFF) through December of 2023. This year, the City also reached agreement with the Alameda Police Officers Association (APOA), Alameda Fire Chiefs Association (AFCA), and Alameda Police Management Association (APMA).

 

The agreements with the five miscellaneous groups and the two Compensation Plans expired on June 30, 2022. The City has now reached agreement with the Police Officer Association, Non-Sworn (PANS) group and is recommending approval of the new labor agreement.

 

The City continues to actively negotiate with the four remaining miscellaneous groups for successor agreements. These groups are:

 

                     Alameda City Employees Association (ACEA)

                     Electrical Utility Professionals of Alameda (EUPA)

                     International Brotherhood of Electrical Workers, Local 1245 (IBEW)

                     Management and Confidential Employees Association (MCEA)

 

BACKGROUND

 

The prior agreement with PANS, representing 22 employees, expired on June 30, 2022.  Negotiations between the City and PANS commenced in February of 2022. Employee salary and benefits continue until a successor agreement is approved. 

 

The revised Memorandum of Understanding (MOU) submitted for approval represents a thirty-six month agreement, commencing July 1, 2022 and ending June 30, 2025.  Elements of the proposed MOU are summarized below. 

 

DISCUSSION

 

The proposed MOU provides salary increases as follows: four and a half percent (4.5%) effective the first full pay period following July 1, 2022; three and a half percent (3.5%) effective the first full pay period following July 1, 2023; and two and a half percent (2.5%) effective the first full pay period following July 1, 2024.

 

In addition to the salary increases, the MOU provides an equity salary increase of 3% effective July 3, 2022 to represented employees in the classifications of Public Safety Communications Supervisor (4070) and Animal Control Officer (4095).

 

To recognize employment tenure and retain experienced employees, the City has agreed to retention pay for Public Safety Dispatchers (4074), Senior Public Safety Dispatchers (4071), and Public Safety Communications Supervisor (4070) classifications. Employee’s regular base monthly salary will increase by one and one half percent (1.5%) upon the satisfactory completion of five (5) years of continuous service with the Alameda Police Department and an additional one and one half percent (1.5%) following the completion of ten (10) years of continuous service with the Alameda Police Department for a total of three percent (3%).

 

The City has agreed to increase the holiday-in-lieu payment, in recognition of the Juneteenth Holiday, to a rate of .0779 of regular salaries paid on a biweekly basis.

 

The effective date for the holiday -in -lieu rate increase and retention pay will be the pay- period starting July 3, 2022.

 

PANS members who were required to report on-site during the COVID state of emergency and were employed with the City as of July 1, 2022, will be provided with a flat monthly payment of $200 a month beginning in July 2022 through June 2023 in recognition of employee’s work to maintain City services and functions.

 

The City also agreed to provide an additional 40 hours of Administrative Leave for the Public Safety Communications Supervisor (4070) effective July 1, 2022, and every July thereafter. This additional 40 hours of Administrative Leave is not available for cash out and will be forfeited if unused.

 

The City and PANS also agreed to meet and confer on a 12 -hour- shift option for the workweek and update MOU sections and departmental policies to reflect this change.

 

At the Association’s request, the City and PANS also agreed to meet and confer on the implementation of a 5% night shift differential for Public Safety Dispatcher (4074) and Senior Public Safety Dispatcher (4071) classifications.

 

The City and PANS also agreed on language to clarify provisions on vacation and sick accruals.

 

Other clarifying language changes are included in the proposed MOU. These proposed language changes include updates to comply with state and federal law and to update resolution number and City Council adoption date of City Recognition, and family illness.

FINANCIAL IMPACT

 

The financial impact of implementing salary and other special pay changes agreed to in the PANS MOU are described in the chart below.

 

 

The cost of the increases for Fiscal Year 2022-2023 are included in the current budget. Additional fiscal year costs will be included in future fiscal year budgets for the Police Department. Labor costs for the PANS bargaining group are allocated to the General Fund.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, pursuant to Guideline section 15378.

 

CLIMATE IMPACT

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

 

RECOMMENDATION

 

Adopt a resolution approving a Memorandum of Understanding (MOU) between the Alameda Police Management Association, Non-Sworn (PANS) and the City of Alameda for a Thirty-Six Month Term Commencing July 1, 2022 and Ending June 30, 2025.
