EXECUTIVE SUMMARY

 

Staff is recommending that City Council designate Community Development Director, Lisa Maxwell, Assistant City Attorney, Len Aslanian, and Assistant Community Development Director, Nanette Mocanu as the real property negotiators for 650 West Ranger Avenue (Building 92) Alameda Point, Alameda, CA, Parcel # 74-1375-2 (Parcel A), and 2450 Saratoga Street, 801 West Ranger Avenue (Building 114), Alameda, CA, Parcel #74-1368-9-2 (Parcel B), which will allow them to meet with City Council in closed session to discuss: (1) price and terms related to a potential purchase by the City of Parcel A, and (2) price and terms of a potential lease or sale of Parcel B in a manner compliant with all applicable laws (including the Surplus Land Act (SLA)) and to represent the City in negotiations with a public or private party.  With respect to Parcel B, to be compliant with the SLA, negotiations will not commence until January 1, 2023, when the legislation making Alameda Point exempt from the SLA goes into effect.

 

BACKGROUND

 

On May 18, 2021, the City Council declared five projects sites, including Parcel A, to be surplus properties under the SLA and authorized the Interim City Manager to comply with the SLA procedure for those sites. That SLA noticing process did not generate any offers for Parcel A, including from any affordable housing developers. At the conclusion of the SLA process, staff notified the State Housing and Community Development Department that the SLA process had been completed for Parcel A.  Having completed the SLA process for Parcel A, the City of Alameda (City) may proceed with disposing of Parcel A to third parties. To commence and inform the disposition process, on August 16, 2022, staff acquired an updated appraisal for Parcel A.

 

On September 6, 2022, the City Council declared nine projects sites, including Parcel B, to be surplus properties under the SLA and authorized the Interim City Manager to comply with the SLA process for those sites. To date, that SLA process has not commenced and the SLA currently precludes the City from negotiating about land that has not gone through the SLA process.  However, on September 30, 2022, Governor Newson signed legislation exempting Alameda Point from the SLA effective January 2023.  Accordingly, following receipt of City Council direction, staff will commence lease or sale negotiations for Parcel B on or after January 1, 2023.

 

To facilitate the disposition of the Premise, staff is recommending that City Council designate Community Development Director Lisa Maxwell, Assistant City Attorney Len Aslanian and Assistant Community Development Director Nanette Mocanu as the real property negotiators for the Premise which will allow them to meet with City Council in closed session to discuss: (1) price and terms for potential purchase by the City of Parcel A, and (2) price and terms of potential lease or sale of Parcel B in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

 

DISCUSSION

 

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, the City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as Parcel A and Parcel B. Staff recommends that the negotiators for negotiations related to Parcel A and Parcel B include Lisa Maxwell, Community Development Director, Len Aslanian, Assistant City Attorney and Nanette Mocanu, Assistant Community Development Director. This will allow those individuals to negotiate on the City’s behalf, based on direction provided by the City Council.

ALTERNATIVES

 

                     Approve Lisa Maxwell, Len Aslanian and Nanette Mocanu as real property negotiators for Parcel A and Parcel B.

                     Identify other staff as negotiators.

                     Choose not to negotiate terms related to a potential purchase of Parcel A and/or a potential sale or lease of Parcel B, and thus do not identify negotiators.

 

FINANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

Approval of real property negotiators is categorically exempt from further review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301, as it involves the negotiation of the price and terms of a lease.

 

CLIMATE IMPACTS

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

 

RECOMMENDATION

 

Approve Lisa Maxwell, Community Development Director, Len Aslanian, Assistant City Attorney and Nanette Mocanu, Assistant Community Development Director as Real Property Negotiators for 650 West Ranger Avenue (Building 92) Alameda Point , Alameda, CA, Parcel # 74-1375-2, and 2450 Saratoga Street, 801 West Ranger Avenue (Building 114), Alameda, CA, Parcel #74-1368-9-2.
