EXECUTIVE SUMMARY

 

In the spring of 2022 the City of Alameda (City) completed negotiations with the Alameda Fire Chiefs Association (AFCA) and the Alameda Police Officers Association (APOA). During these negotiations AFCA was provided with retention pay. APOA had previously had retention pay but during negotiations the provision describing this pay was updated.

 

Since the completion of negotiations, there have been discussions with AFCA and APOA regarding retention pay.  . In the APOA Memorandum of Understanding (MOU) there is concern the language in the MOU does not reflect the correct calculation for retention pay.

 

In the AFCA MOU the language in the MOU is correct, but the salary schedule does not reflect the correct calculation of Management Incentive Pay. The previously approved Salary Schedule mistakenly omitted Retention Pay in the calculation of Management Incentive Pay. The recommended salary schedules now includes the correct calculations for Management Incentive Pay.

 

In order to clarify the intent of the provision it is recommended to update the retention pay language in the APOA MOU and to update the salary schedule for AFCA.  These actions will ensure the pay is correctly calculated.

 

 BACKGROUND.

 

On May 3, 2022, the City Council adopted a resolution approving MOU between the Alameda Fire Chiefs Association (AFCA) and the City. On February 15, 2022, the City Council adopted a resolution approving the MOU between the APOA and the City. While the MOUs approved by the City Council included retention pay, the specific language in the provision for this pay needs to be updated in the APOA MOU to reflect how this pay is calculated and the salary schedule for AFCA needs to be updated to correctly reflect the calculation of Management Incentive Pay to include retention pay.  

 

DISCUSSION

 

As part of negotiations with AFCA, a new provision providing retention pay was added to the agreement between AFCA and the City. However, when the agreement including the salary schedule was approved by City Council, the Salary schedule did not correctly reflect the calculation of the pay. Based on the language in the MOU, retention pay should be included in the calculation of Management Incentive Pay, however this is not reflected in the salary schedule previously approved by City Council. Staff are now recommending approval of the corrected AFCA salary schedule.

 

While the salary schedule for APOA was correct the language in the MOU needs clarification to properly reflect the intention of the parties.  The parties have now updated the language and are recommending approval of the revised MOU.

 

FINANCIAL IMPACT

 

There is no financial impact from the proposed revisions to the retention pay provision in the APOA MOU. The revision to the language will ensure the pay continues to be correctly calculated in the future.

The financial impact of the updating of the salary schedule for AFCA is estimated to be $10,000 annually.  The Fire Department has sufficient funding to cover this additional cost in their Fiscal Year 2022-23 budget.

This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, pursuant to Guideline section 15378,

 

CLIMATE IMPACT

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

 

RECOMMENDATION

 

Adopt a resolution to approve administrative corrections to revise the language for retention pay in the Memorandum of Understandings (MOU) between the Alameda Police Officers Association and update the salary schedule for the Alameda Fire Chiefs Association to reflect the correct calculation of Management Incentive Pay.
