EXECUTIVE SUMMARY

 

Staff is recommending that City Council designate Jennifer Ott, City Manager, Amy Wooldridge, Assistant City Manager, Lisa Maxwell, Community Development Director, Len Aslanian, Assistant City Attorney, Lois Butler, Economic Development Division Manager, and Lisa Fitts, Community Development Manager as the real property negotiators for 1900 Thau Way, Alameda (Premises), which will allow them to meet with City Council in closed session to discuss price and terms related to occupancy of the Premises in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

 

BACKGROUND

 

The Alameda Emergency Food, Inc. (Food Bank) is currently leasing the Premises, which includes a trailer, for use as offices, storage and a food pickup location for food insecure Alameda residents. The lease with the Food Bank commenced on February 1, 1991, expired on February 1, 2016 and has been month-to-month since that time. The Food Bank requested to terminate the lease as soon as practical and transfer the on-site trailer to All Good Living Foundation (AGLF).

 

AGLF is interested in leasing the Premises for four years and eleven months and accepting the transfer of the trailer. AGLF’s use would be providing community services to those in need, including students, families, school staff and the unhoused, by distributing clothing, toiletries and food.  The trailer use is for an onsite office and storage.

 

Staff is recommending that City Council designate Jennifer Ott, City Manager, Amy Wooldridge, Assistant City Manager, Lisa Maxwell, Community Development Director, Len Aslanian, Assistant City Attorney, Lois Butler, Economic Development Division Manager, and Lisa Fitts, Community Development Manager, as the real property negotiators for the Premises, which will allow them to meet with City Council in closed session to discuss price and terms for this property in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

 

DISCUSSION

 

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as the Premises. Staff recommends that the negotiators for negotiations related to the Premises include Jennifer Ott, City Manager, Amy Wooldridge, Assistant City Manager, Lisa Maxwell, Community Development Director, Len Aslanian, Assistant City Attorney, Lois Butler, Economic Development Division Manager, and Lisa Fitts, Community Development Manager. This will allow these individuals to negotiate on the City’s behalf, based on direction provided by City Council.

 

ALTERNATIVES

 

                     Approve Jennifer Ott, Amy Wooldridge, Lisa Maxwell, Len Aslanian, Lois Butler, and Lisa Fitts as real property negotiators for the Premises.

                     Identify other staff as negotiators.

                     Choose not to negotiate terms related to occupancy of the Premises, and thus do not identify negotiators.

 

FINANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report. 

 

RECOMMENDATION

 

Approve Jennifer Ott, City Manager, Amy Wooldridge, Assistant City Manager, Lisa Maxwell, Community Development Director, Len Aslanian, Assistant City Attorney, Lois Butler, Economic Development Division Manager, and Lisa Fitts, Community Development Manager Real Property Negotiators to negotiate with All Good Living Foundation regarding property located at 1900 Thau Way, Alameda, CA 94501.
