BACKGROUND

 

On October 18, 2016, the City Council approved the City of Alameda’s project list for submittal to the Alameda County Transportation Commission (ACTC) for funding as part of its Combined Call for Projects for its 2018 Comprehensive Investment Plan (2018 CIP) for Fiscal Years 2017/18 through 2021/22. The 2018 CIP represented a consolidated process for ACTC to program not only local monies such as Measure B and BB but also to program federal, state and regional transportation funding.

 

On April 27, 2017, ACTC approved funding for six City of Alameda projects totaling $34,927,000, for the following projects:

 

1)                     New Ferry Terminal at Seaplane Lagoon - $8.2 Million in FY 2019-20 for construction phase;

2)                     Central Avenue Complete Street (Main/Pacific to Sherman/Encinal) - $3.5 million (federal monies) in FY 2019-20;

3)                     Clement Avenue Complete Street (Broadway to Grand) -  $5 million (federal monies) in FYs 2017-19 for environmental/design phase and FY 2019-20 for construction phase;

4)                     Appezzato Parkway Dedicated Bus Lanes - $9 million in FYs 2017-19 for planning/environmental/design phase and FY 2019-20 for construction phase;

5)                     Clement Avenue East Extension and Tilden Way including Right-of-way Purchase - $8.4 million in FYs 2017-19 for planning/environmental/design/ROW phases and FY 2019-20 for construction phase; and

6)                     City-wide Street Resurfacing: Pavement Management - $827,000 (federal monies) in FY 2019-20 for construction phase.

 

Subsequently, the City Council approved the 2017-2019 Capital Budget on June 6, 2017, which included all of the above projects with the above listed funding. The project sheets for the three transportation projects that require an ACTC funding agreement are attached as Exhibit 1.  

 

DISCUSSION

 

Implementation of the projects funded with Measures B and BB funds require that the City enter into a Project Funding Agreement (Exhibit 2) with ACTC for each applicable project. This applies to the following three of the six funded projects:

 

1)                     New Ferry Terminal at Seaplane Lagoon - $8.2 Million

2)                     Appezzato Parkway Dedicated Bus Lanes - $9 million

3)                     Clement Avenue East Extension and Tilden Way including Right-of-way Purchase - $8.4 million

 

The Project Funding Agreement obligates funds from one or more ACTC administered funding programs and outlines the requirements for reimbursement of project-related expenses.  These specific requirements are outlined in the following Appendices:

Appendix B-   Funds Obligated by the Agreement

Appendix C - Request for Reimbursement and Reporting Requirements

Appendix D - Funding Shift Approval

Appendix E - Local Business Contract Equity Program

To streamline the approval process and execution of the three necessary Project Funding Agreements by the City Manager, staff is requesting that the City Council approve the form of the agreement and authorize the City Manager to sign the agreement for each project, as long as it is substantially in the same form as that shown in Exhibit 2.  While each individual project will have specific project-level details consistent with the specific funding application for that project from the 2018 CIP submittal, the form of the agreement will be the same for all of the projects.

 

FINANCIAL IMPACT

 

The proposed action has no financial impact to the General Fund or any other funds.

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

The action implements ACTC’s award of funding to the City for three of the six projects approved by the City Council on October 18, 2016 as part of a competitive funding submittal in response to ACTC’s Call for Projects for its 2018 CIP.

 

ENVIRONMENTAL REVIEW

 

The City Council’s action is exempt from California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines sections 15061(b)(3) (general rule), 15183 (projects consistent with a community plan, general plan or zoning), and 15378(b)(4) (other government fiscal activities), each of which provides a separate and independent basis for CEQA clearance and when viewed collectively provide an overall basis for CEQA clearance.

 

This action does not constitute an approval of the Appezzato Parkway Dedicated bus lines or Clement Avenue East extension and Tilden Way, including right of way purchase projects funded by the ACTC grants, and subsequent approval of these projects is subject to CEQA review.  The new ferry terminal at Seaplane Lagoon relies on the Site A Project EIR and no further environmental review is required.

 

RECOMMENDATION

 

Adopt a resolution authorizing the Acting City Manager to execute documents necessary to accept grant funding from the Alameda County Transportation Commission for three transportation projects.
